# Copyright & DMCA Policy

In short

- Respect other people's copyrights when you use DuckyHelper.
- If you believe something on DuckyHelper infringes your copyright, send a notice to our designated agent with the details below.
- If your content was removed by mistake, you can send a counter-notice.
- We close the accounts of repeat infringers.

**MingLLM, Inc.** respects intellectual property rights and expects people who use DuckyHelper to do the same. This policy follows the US Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and is part of the [Terms of Service](https://duckyhelper.com/terms/).

Most of what's in DuckyHelper is private to each account (your sessions, memories and files) and isn't published to anyone. Our website, emails and anything shared publicly can still be the subject of a notice.

## 1. Our designated agent

## 2. Sending a notice

Your notice must be in writing (email is fine) and include:

1. your physical or electronic signature;
2. what copyrighted work you believe was infringed (or, for many works, a representative list);
3. what you believe infringes it and where it is, with enough detail for us to find it (for example, a link);
4. your name, mailing address, phone number and email address;
5. a statement that you have a good-faith belief that the use isn't authorized by the copyright owner, its agent or the law; and
6. a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.

We may share your notice (with your contact details removed where possible) with the person whose content it concerns. A notice that misrepresents that something infringes can make the sender liable for damages under 17 U.S.C. § 512(f).

## 3. Sending a counter-notice

If content of yours was removed and you believe it was a mistake or misidentification, send our agent a counter-notice with:

1. what was removed and where it was before;
2. a statement, under penalty of perjury, that you have a good-faith belief it was removed by mistake or misidentification;
3. your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you're outside the US, any judicial district where MingLLM can be found), and that you'll accept service of process from the person who sent the notice or their agent.

We'll forward it to the person who sent the notice. Unless they tell us within 10 business days that they've filed a court action, we may restore the content 10 to 14 business days after we receive your counter-notice.

## 4. Repeat infringers

We close the accounts of people who repeatedly infringe copyrights, in appropriate circumstances.
