## Changes

### October 2, 2026: version 1.1 of the Terms, Privacy Policy, Billing, AI Use, Children's Privacy Notice, Cookie Policy and Subprocessors

- **October 2, 2026 (same day, still version 1.1):** DuckyHelper no longer uses passwords. You sign in with a one-time code sent to your email; the Terms, Privacy Policy, Security page and Children's Privacy Notice say so, and a parent now chooses only a child's sign-in email. This only reduces what we collect.

Invites, where sign-ups come from, typing with Ducky, and where code runs. If you already have an account, DuckyHelper asks you once to accept the new Terms of Service, Privacy Policy, Billing terms and AI Use guide; new accounts accept them when they sign up. The Acceptable Use Policy, macOS App License, Security and Copyright documents stay at 1.0.

- **Terms of Service 1.1**: section 10 is now "Plans, payments, refunds and invites" and introduces invites: optional, for 13 and older, account credit and never cash, the rules in the Billing terms, what misuse costs, and that we may change or end them. Section 3 says that what you type to Ducky goes to OpenAI too.
- **Billing, Subscriptions & Refunds 1.1**: a new section 13, Invites: who can take part; the friend's 80 credits (about 10 minutes of live voice) after 2 minutes of talking in one session, for at most 30 friends a day and 100 a month per link; the inviter's account credit ($20 when the friend's first plan is Plus, $50 for Pro or Unlimited, added once that first payment is 14 days old, at most 20 rewards a month); when there's no reward; taking it back after a later refund or dispute; how account credit works (a Stripe balance for plan payments only, never cash); fair play; changes. Statements and receipts and Contact are now sections 14 and 15. Section 5 now says credits also pay for live voice on Free, and that credits we give last 12 months too. This version also carries the Free plan change of October 2 (below), so learners accept it with this version (REVIEW.md item 37).
- **Privacy Policy 1.1**: a new section 1K: where a sign-up came from (campaign tags, the referring site, the first page, an invite code; only the invite code under Global Privacy Control), where you made your account (the Mac app or a browser, on a Mac or not), the "How did you hear about us?" answer, and invite records, what they're used for, and that none of it applies to children under 13. Section 1B now covers what you type to Ducky and code you run (Python in the web app runs on our servers), and says your voice goes straight to OpenAI from the Mac app or from your browser, with sections 2 and 4 to match; 1I lists `dh_ref` and `dh_touch`; section 5 says what an inviter sees; section 6 has retention rows for these records; section 9's California categories include them.
- **Children's Privacy Notice 1.1**: what a child types to Ducky and code they run are listed in what we collect, with OpenAI's and AWS's roles to match; their voice goes straight to OpenAI from the Mac app or the browser; it says plainly that invites and where sign-ups come from don't apply to children.
- **AI Use & Academic Integrity 1.1**: typed answers, and where code runs (the Mac app on your Mac; in the web app, Python on our servers and JavaScript and TypeScript in your browser).
- **Cookie Policy 1.1**: two new rows in the tab's session storage, `dh_ref` (Necessary: an invite link's code) and `dh_touch` (Analytics: where the visit started); `dh_device` is also used so nobody can invite themselves. Rows for `ducky.app`, `dh_download` and `dh_session`, which the site already used, are added too.
- **Subprocessors 1.1**: no new subprocessor. OpenAI receives your voice from the Mac app or the browser, and also typed messages; AWS also runs the web app's Python code, and Stripe also holds invite rewards.

### October 2, 2026: Billing describes the new Free plan (still version 1.0, see REVIEW.md item 37)

- **Billing, Subscriptions & Refunds**: the Free plan is now 3 minutes of live voice once per account, then typing with Ducky up to a number of messages a day; live voice on Free after that uses bought or given credits; Free can pause for the rest of a day when its shared daily budget is used. "In short" and section 1 say so. Paid plans, prices, renewal, credits and refunds are unchanged. This takes away Free's weekly talking time, so it may be a material change: until it is decided (REVIEW.md item 37), the version stays 1.0 and nobody is asked to accept again.

### October 1, 2026: version 1.0 of every document

The first complete set, replacing the September 26, 2026 Terms of Service and Privacy Policy (early access, no payments, no age check):

- **Terms of Service 1.0**: MingLLM, Inc. (Delaware); ages (13+, 13 to 17 with a parent's OK, under 13 only with a parent's verifiable consent); AI limits and academic integrity; the user content license limited to running the service and no training; paid plans by reference to the Billing terms; arbitration with a 30-day opt-out and no class actions; Delaware law.
- **Privacy Policy 1.0**: rewritten for the app as it is today (voice straight to OpenAI, screenshots and live viewing, on-screen actions, memories with pictures and files, Google connections, payments, emails, the website's consent-based analytics), a retention table, rights and how to use them, California notice, children, transfers.
- **Children's Privacy Notice 1.0** (new): the parent consent flow with a card check, what is collected, retention (sessions 1 year, idle accounts 1 year), parents' rights.
- **Billing, Subscriptions & Refunds 1.0** (new): plans, automatic renewal, cancelling online, credits, auto top-up, fair use, refunds, failed payments.
- **Acceptable Use Policy 1.0**, **AI Use & Academic Integrity 1.0**, **macOS App License 1.0**, **Cookie Policy 1.0**, **Subprocessors 1.0**, **Security & Responsible Disclosure 1.0**, **Copyright & DMCA Policy 1.0** (all new).
- **October 2, 2026 (still version 1.0):** contact details only: the Children's Privacy Notice now gives MingLLM, Inc.'s mailing address (care of its registered agent, the same address as the Copyright Policy), and the Children's Privacy Notice and Copyright Policy say the phone line is being set up, with the email to use until then.
- **October 1, 2026 (same day, still version 1.0):** a wording clarification in the Privacy Policy: the website's email sign-up is for "study tips and news" (it said "study tips and early access"). What it sends, how often and unsubscribing any time are unchanged.

### September 26, 2026: Terms of Service and Privacy Policy (early access)

The first pages on duckyhelper.com/terms/ and /privacy/, written for the early-access app with no payments. Replaced by version 1.0.

- **October 1, 2026 (same day, still version 1.0):** clarifications that only reduce what we share: DuckyHelper no longer makes AI videos, so Google's Gemini API is no longer a subprocessor and video is removed from the Terms, Privacy Policy, Billing, AI Use and Children's Privacy; the Terms now say you can delete your account yourself in Settings > Account.
