Terms of Service

1. Early Access

DuckyHelper is in early access. It is a Mac app, and there is no public download yet. Features may change, stop working, or be removed, and we may limit or end early access at any time. We may ask you what you think so we can make it better.

2. Your Account

You create a DuckyHelper account on our sign up page with an email address and a password. To create one, you must agree to these Terms and to the Privacy Policy. We do not verify email addresses yet, so make sure yours is correct. Your account is kept in the same account system as Loom, another MingLLM product, so the same account also works with Loom. Sign in with Google, Apple, or X is not available yet.

• Give us accurate information and keep it up to date.
• Keep your password safe. You are responsible for what happens in your account.
• Tell us right away if you think someone else is using your account.

3. How DuckyHelper Works

To tutor you, DuckyHelper listens to your microphone while the pill is open, takes screenshots and watches for changes on your screen during a session, and follows your clicks and typing during tutorials. It sends your voice, screenshots, and descriptions of your screen to AI providers so it can answer you. The Privacy Policy explains exactly what is sent, where, and what we keep.

You choose what DuckyHelper can use through the permissions in macOS, and you can end a session at any time. Do not point DuckyHelper at things you are not allowed to share, such as other people's private messages or confidential work.

4. Your Content

"Your Content" means what you say, show, and type to DuckyHelper, and what it makes for you, such as transcripts, notes, tests, flashcards, pictures, and videos. You keep the rights you have in Your Content.

You give MingLLM permission to store, copy, process, and display Your Content only to provide the Services to you, to keep them secure, and to support you. You are responsible for having the right to share what you share with DuckyHelper.

5. AI Can Be Wrong

DuckyHelper uses AI. Its answers, drawings, steps, grades, and tests can be wrong or incomplete, and it can point at the wrong thing. Check anything important with another source. DuckyHelper does not replace a teacher, and it does not give medical, legal, financial, or other professional advice. When Ducky looks something up on the web, the results come from other websites that we do not control.

6. Learning Honestly

DuckyHelper is for learning. Follow your school's rules about AI, homework, and tests. Do not use DuckyHelper during a test, quiz, or exam unless you are allowed to, and do not hand in its work as your own where that is not allowed.

7. Rules for Using DuckyHelper

You agree not to:

• Break the law, or use DuckyHelper to harm, bully, harass, or deceive anyone.
• Create or share sexual content involving minors, or any content that exploits or endangers children.
• Share other people's private information without their permission.
• Try to get around usage limits, security, or safety features, or use someone else's account.
• Copy, take apart, or reverse engineer the app, except where the law allows it.
• Overload or disrupt the Services, or access them with bots or scripts we have not approved.
• Sell, rent, or resell access to DuckyHelper.

You must also follow the rules of the AI providers DuckyHelper uses, which apply to what you ask it to do.

8. Usage Limits

Your account has monthly limits on minutes of live voice and on the pictures and seconds of video Ducky can make. The app tells you when you reach a limit. We may change limits during early access. DuckyHelper does not charge you today. If we add paid plans, we will show the price and terms before you pay anything.

9. Other Services

DuckyHelper relies on other companies, including OpenAI, Google, and Amazon Web Services. It also works on top of the apps and websites you use every day. Those services have their own terms, and we are not responsible for them.

10. Our Intellectual Property

MingLLM owns DuckyHelper, including its software, design, the DuckyHelper name, and the duck logo. While these Terms apply, we give you a personal, non-exclusive, non-transferable permission, which we can take back, to use the DuckyHelper app on your own Mac. You may not use our name or logo without our written permission.

11. Feedback

If you send us ideas or feedback, we may use them to improve DuckyHelper without owing you anything.

12. Ending Your Use

You can stop using DuckyHelper at any time and ask us to delete your account. We may suspend or end your access if you break these Terms, if we need to protect you, other people, or the Services, or if we stop offering DuckyHelper. Parts of these Terms that should last after that, such as sections 4, 10, and 13 to 15, keep applying.

13. Disclaimers

As far as the law allows, DuckyHelper is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties that it will be accurate, uninterrupted, error free, or fit for a particular purpose. Some places do not allow these disclaimers, so some of them may not apply to you.

14. Limitation of Liability

As far as the law allows, MingLLM will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or lost opportunities, that come from your use of DuckyHelper. As far as the law allows, our total liability for any claim about the Services is limited to the greater of the amount you paid us for the Services in the 12 months before the claim, or US$50. Some places do not allow these limits, so they apply to you only as far as your law allows.

15. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules. If you are a consumer, you also keep any protections that the law where you live gives you and that cannot be waived.

16. Changes to These Terms

We will update these Terms when DuckyHelper changes, and we will change the "Last updated" date at the top. If a change is important, we will tell you in the app or by email before it takes effect. If you keep using DuckyHelper after a change takes effect, you accept the new Terms.
